As part of the Advancing Justice Issue Team, the Advancing Justice Staff Attorney will help to design, coordinate, and implement strategic litigation and integrated advocacy that challenges police practices, expands protections against police power and other components of the criminal legal system. The ACLUF-SDIC is a nonpartisan, not-for-profit 501(c)(3) civil liberties and civil rights organization. working to advance equality, freedom and justice through public education and litigation. Together with the ACLU of San Diego & Imperial Counties, the 501(c)(4) nonprofit organization that does our legislative lobbying work, we are a prominent force for the protection and expansion of fundamental rights in California’s second-most populous county (San Diego) and the county with the highest per capita Latina/o population (Imperial).

The Advancing Justice Staff Attorney is responsible for investigating, analyzing, and addressing issues in the criminal legal system in San Diego & Imperial Counties that may be caused by violations of legal and policy protections and/or prevented by improvements in those protections. Working within the affiliate’s Advancing Justice Issue Team and in collaboration with the statewide ACLU of California Police Practices and Criminal Justice Issue Teams, the attorney will work to devise and implement strategies to address problems through legal advocacy and litigation, policy reform and implementation, community education, and strategic communications.

The Advancing Justice Staff Attorney will be in the Advocacy and Legal Department and supervised by the Advocacy and Legal Director with the Managing Legal Director providing supervision on litigation matters.

Primary Duties and Responsibilities:

The ACLU SDIC’s “integrated advocacy” model unites legal advocacy, policy advocacy, organizing, communication strategies and base building for maximum impact. In keeping with that approach, the Staff Attorney will work on cases, advocacy projects, public education, and campaigns. The attorney’s responsibilities will be the following:

  • Working with the Advancing Justice Issue Team, Managing Legal Director and impacted communities identify, research, develop, and pursue legal and policy initiatives consistent with affiliate priorities developed through the Advancing Justice Issue Team;
  • Provide legal and policy expertise on issues related to the criminal legal system, especially police practices, including by:
    • researching, drafting, or editing legal advocacy letters, amicus briefs, legislation, regulatory comments, reports, policy briefs and coalition sign-on letters;
    • participating in legislative briefings and meetings with federal, state, and local government officials; contributing legal analysis and support to designated legal, policy, organizing, communications, or development work of the affiliate as appropriate; and
    • conducting legal and policy research to support the Advancing Justice Issue Team;
  • Investigate, monitor, and advocate for local and federal compliance with existing legal and policy requirements, and identify and develop strategies and novel legal claims to challenge police practices under state and federal law, investigating practices of police departments and other law enforcement agencies for potential litigation and/or advocacy work, and identifying opportunities to leverage impact litigation to catalyze policy efforts in local communities;
  • Research and maintain up-to-date awareness of current tactics and trends related to the criminal legal system, especially as it relates to policing, and communicate those tactics and trends as appropriate to the Advancing Justice Issue Team and appropriate affiliate staff as well as across the ACLU state and national organizational structure;
  • Participate in strategic litigation and direct service representation as necessary or appropriate, consistent with priorities developed by the Advancing Justice Issue Team and under the supervision of the Managing Legal Director;
  • Provide technical support and strategic leadership and support to community partners, allies, stakeholders, and coalitions in the region, and build and nurture relationships by participating in regular meetings with community leaders and members and pursuing shared advocacy goals with them;
  • Draft content for “Know Your” materials, op-eds, blog posts, and other media regarding the criminal legal system, and participate in community outreach, education, and public speaking on issues impacting the Advancing Justice issue area;
  • Supervise investigators, interns or fellows as needed, and support summer intern hiring.

Our Must Haves:

  • Commitment to racial justice and civil liberties principles;
  • Current attorney with proven litigation experience in state and/or federal court.
  • Applicants must have excellent research, writing, analytic, interpersonal, communication, and time-management skills, as well as patience, emotional intelligence and cultural competency. Applicants must be able to occasionally work evenings and weekends, and travel as needed inside or outside the U.S.
  • Strong candidates will have demonstrated experience using advocacy, community engagement, and litigation as part of a creative response to civil rights violations in affected communities; relevant experience working on issues related to the criminal legal system; and be a flexible team player but also comfortable working independently and taking initiative.
  • Must be admitted to the California Bar.

Demonstrated awareness of one’s own cultural identity, views about differences, and the ability to learn and build on varying cultural and community norms. A complex understanding of racial justice and the urgency of confronting institutional racism and inequity. Commitment to equity and inclusion as organizational practice and culture. Proven track record of working across lines of race, immigration status, ethnicity, language, class, gender and other identities and experiences including record of arrest or conviction. Physical Requirements:

While performing the responsibilities of the job, the employee is required to exchange accurate information, detect/identify documents and the information contained in them, move between areas in and out of the office to complete their role. The employee may need to move various equipment including computer to their work location.

Hybrid Working:

The ACLUF-SDIC is headquartered in San Diego, California, though employees have hybrid schedules that allow for remote work.

Travel Requirements: Must be able to travel for court hearings and conferences as needed.

Compensation:

The classification salary range for this position is $79,000 to $118,000 and the anticipated hiring range is: $85,000 - $90,000. Salary will be determined by a variety of factors, including the knowledge, skills, and experience of the individual selected.

Our mission is to break cycles of incarceration and build an equitable justice system by providing young people with individualized advocacy, mentorship, and opportunities to grow, thrive, and lead. Youth Justice Network builds on connections developed with young people whose lives have intersected with the justice system, and leverages those relationships to provide post-release, neighborhood-based supportive services. Young people become members of Youth Justice Network for the long-term and develop personal milestones and goals in the arenas of health and well-being, education, employment, youth leadership and community participation.

Position Background

As part of Youth Justice Network’s advocacy team, Youth Advocates are at the core of implementing an innovative system of pre-release planning and neighborhood-based aftercare and support for the youngest people admitted to and released from DOC and ACS custody in New York City. Youth Advocates serve as mentor, case manager, navigator, facilitator and coach to individual youth with whom they first connect upon admission to facilities. The primary work of the Youth Advocate takes place in the New York City neighborhoods to which these youth return.

Objectives of this Role

  1. Work closely with the Shifting Gears team weekly to conduct outreach across Staten Island and connect justice-impacted youth to YJN services using our advocacy model as the foundation.
  2. Reach out to the youth's significant other/family and other potential support systems available to the youth; to develop a healthy rapport and create a support system for the young adult.
  3. Build relationships via teleconferencing with young people who are in custody and anticipate release to the Staten Island community.
  4. Continuously engage with the youth and sustain regular communication as they navigate challenges within the system, including Rikers Island, the criminal justice system, and post-release supports in the community.
  5. Gather relevant information to create an individualized plan that includes reaching out to community organizations that will serve the young people while in the community or upon release.
  6. Collaborate with local community-based organizations, faith-based services, local precincts, and human resource agencies to establish a network of support and resources for the youth.
  7. Gauge young person’s readiness to make positive changes/improvements in their life.
  8. Collaborate with the in-house court advocacy team to identify young people who need additional support at court, and assist young people with following through on this plan.
  9. Facilitate and support youth enrollment, engagement, and academic advancement.
  10. Provide one-on-one and group mentoring in the Staten Island community or from the Brooklyn YJN hub to build relationships and support young people toward achieving positive youth outcomes.
  11. Connect youth to post-release neighborhood-based services, both in-house and through partner organizations, to support individual progress in overall youth development and to leverage natural supports and services in the neighborhood on behalf of youth members.

Requirements

The Senior Attorney will build on this highly successful work to maintain a constant stream of litigation in one or more of our impact areas. The Senior Attorney’s areas of focus will be determined based on relevant experience and interest, as well as organizational need.

The Senior Attorney will actively develop litigation and will also support strategic policy advocacy, community outreach, and communication efforts to ensure the organization’s visibility across diverse communities and social justice movements.

The Senior Attorney will report to LCR’s Litigation Director or Deputy Litigation Director.

This position is full-time (40 hours/week) and will require flexibility to work evenings and weekends as needed. We currently employ a hybrid work environment, with Senior coming into our office in downtown Boston at least once a week for Senior meetings on Mondays. The Senior Attorney should have the ability to travel statewide, and to a lesser degree nationwide, as needed for court proceedings and other events.

SUMMARY OF KEY RESPONSIBILITIES (% of time spent)

Case Development and Litigation (80%)

Develop and maintain a significant caseload of civil rights matters in federal and state court. Actively engage in litigation through the following activities:

  • Devise legal theory and strategy;
  • Evaluate and investigate potential claims;
  • Identify plaintiffs;
  • Handle intakes;
  • Work with pro bono law firms;
  • Conduct all aspects of legal research;
  • Draft pleadings, motions, and briefs;
  • Conduct depositions and written discovery;
  • Engage in trial and appellate work;
  • Negotiate and monitor settlement agreements;
  • Pursue attorney fee awards; and
  • Coordinate amicus briefs.

The Senior Attorney will ensure the development of a consistent pipeline of new cases that will be co-counseled with pro bono law firms.

The Senior Attorney will also ensure the measurable quarterly growth of the litigation docket, and participate in weekly supervision meetings to assess work and quarterly productivity meetings to assess the volume of cases. Tracking work and “billable” hours is required for quarterly reports.

While developing and litigating cases, the Senior Attorney will ensure that all internal and external work is aligned with the organization’s brand, policies, procedures, and protocols.

Policy Advocacy, Community Outreach, and Organizational Visibility (10%)

Participate in community outreach, policy advocacy, legislative advocacy, and community meetings that are strategically aligned with the development of impact litigation and policy reform in targeted areas. Leverage policy advocacy and community outreach to ensure that our organization remains highly visible across diverse communities and social justice movements.

Represent the organization in meetings with stakeholder and constituent groups. Participate in traditional media appearances (newspaper, TV, radio); social media activities; and other communication efforts, including drafting community education materials, press releases, and newsletters. Support fundraising efforts.

Leadership and Supervision (10%):

Serve as a resource for attorneys at pro bono law firms working on LCR cases. Provide leadership and supervision for fellows, interns, and administrative staff. Actively develop expertise in substantive areas of civil rights law and legal practice. Participate in the development of long-term strategic goals and objectives for the organization.

Your ability to develop and maintain a substantial litigation caseload in state and federal court, typically in collaboration with pro bono law firms, will ensure continued success and growth in this role. We will also assess how you apply technical knowledge, analyze problems, and calculate risks to achieve strong outcomes.

3. SUCCESSFULLY ENGAGING IN POLICY ADVOCACY AND COMMUNITY OUTREACH TO ADVANCE LCR’S MISSION AND ENHANCE LCR’S VISIBILITY:

Your role in advancing our mission through policy advocacy and community outreach is critical. Success in this area will be evaluated based on your ability to align policy and community outreach with our complex litigation and policy reform work, as well as your capacity to build and expand strategic relationships that further our mission.

4. SUCCESSFULLY EXERCISING LEADERSHIP DUTIES:

We will assess your leadership in supporting and strengthening key aspects of our organization, including litigation protocols, office management, social media, communications, and fundraising efforts. Your contribution in these areas is essential to strengthening our overall impact and operations.

QUALIFICATIONS

Applicants must be extremely hard-working, highly self-motivated, well-organized, community-oriented, creative, analytical, and passionate about civil rights, racial justice, and social change.

Applicants must also be fully committed to measuring their effectiveness and impact every quarter.

Applicants must have:

  • JD and at least seven years of litigation experience that could include clerkship.
  • A demonstrated track record of successfully litigating cases in federal either state courts, preferably in one or more of LCR’s impact areas.
  • An active membership in the Massachusetts bar in good standing, or ability to waive in.
  • Excellent writing and analytical skills.
  • Outstanding interpersonal, organizational, and leadership skills.
  • The ability to work productively and efficiently with minimal supervision.
  • A demonstrated commitment to racial justice and civil rights.
  • Language skills are a plus, particularly the ability to communicate fluently in a language relevant to immigrant communities (including, but not limited to, Mandarin, Haitian Creole or Spanish).

COMPENSATION

LCR’s salary range for this is $110,000 - $130,000. The exact compensation will be based on years of litigation experience. Salary will also consider the number of successful cases in federal and state courts, and familiarity with complex impact litigation and class actions.

Summary:

We currently have an opening for a litigation attorney to handle a personal docket of FINRA arbitration claims and to assist with overall management and administration of legal claims and issues involving our 11,000 financial professionals.   • Administration of claims and interaction with our insurance carriers including claim filing, status reporting, and preparation of proofs of loss related to all insurance policies;
  • Administration of cases placed with outside counsel;
  • Handling of a broad variety of legal inquiries related to our 11,000 independent financial professionals;
  • The attorney serving in this position will be part of a fast-paced, dynamic work-environment, requiring strong writing and communication skills; oral advocacy skills; legal and analytical skills; a creative approach to problem solving; a demonstrated ability to multi-task and to work successfully on time-sensitive matters; the ability to work as part of a team collaborating with other counsel and business or compliance personnel;
